O’Reilly Auto Parts sued over pre-employment credit report violations
Three branches of O’Reilly Auto Parts stores are being taken to court in California after a prospective employee claimed that his employment offer was revoked after a credit check, and that he was not given the chance to review it for accuracy per the Fair Credit Reporting Act. Raphael Saye had received a job offer from one of the O’Reilly locations in August 2013, but once a credit check had been completed, his offer was rescinded and he was not allowed to view the report or ensure that the information in it was accurate, despite allegedly requesting his own copy during the application process. He filed suit against O’Reilly Automotive Inc. on May 5, 2014. Saye also alleges that the company violated the Fair Credit Reporting Act, claiming three O’Reilly Automotive Inc. subsidiaries’ pre-authorization forms contained unnecessary information and did not “consist solely of the disclosure that a consumer report may be obtained for employment purposes,” per the Fair Credit Reporting Act definition. He alleges that this information was embedded in a text link within the online job application and did not stand alone as is required by law.
