The new legislation in question is the “Fairness and Accuracy in Employment Background Checks Act of 2010” . This states that a person’s arrest record would be dropped from the database if the disposition of the case remains unknown or cannot be determined after one year. In short, if there is an arrest but no trial within a year, the arrest will no longer be visible in a background check. This could lead to many problems, most significantly the hiring of inappropriate individuals. With many quarters hoping to see this legislation overturned, it seems that those trying to enforce it have a battle on their hands. There is no doubt that it could cause many issues for any businesses who work hard to maintain safety and security within their workplace, and it will be interesting to see what happens with this in the future.]]>
